These General Terms and Conditions of Sale (the “Terms”) govern every purchase made on the online shop of Aziende Agricole Scyavuru S.r.l. (the “Shop”). By placing an order you confirm that you have read, understood and accepted these Terms. Please read them carefully and keep a copy for your records.
The products offered on the Shop are sold by Aziende Agricole Scyavuru S.r.l., with registered office in Contrada Castellana SNC, 92016 Ribera (AG), Italy, VAT number IT02397210846 (the “Seller”). You can contact the Seller at [email protected].
These Terms apply to distance contracts concluded through the Shop between the Seller and any customer who purchases products as a consumer, i.e. a natural person acting for purposes outside their trade, business, craft or profession. Sales are governed by Italian law and in particular by Legislative Decree no. 206/2005 (Consumer Code) and Legislative Decree no. 70/2003 (E-commerce). Professional customers, retailers, distributors and Horeca operators are invited to contact the Seller for dedicated commercial conditions.
The Shop offers pistachio and nut-based creams, pure pastes, toppings and related food products. Each product page shows the essential characteristics of the product, ingredients, allergens and net weight. Product images are for illustration only: in case of any difference, the written description prevails. Products are food items and must be stored and consumed as indicated on the label. Availability is shown on each product page and may change without notice.
All prices are expressed in Euro and include VAT. Shipping costs, if any, are not included in the product price and are shown separately at checkout, before the order is confirmed. The Seller may change prices at any time; the price charged is the one displayed at the moment the order is placed. In the event of an obvious pricing error, the Seller reserves the right to cancel the order and refund any amount paid.
To place an order you add products to the cart, enter your billing and delivery details, choose a payment method, accept these Terms and confirm the order. Before confirming you can review and correct the information entered. The order is a binding offer to purchase; the contract is concluded when the Seller sends the order confirmation email to the address you provided. The Seller may refuse or cancel an order, for example if the products are unavailable, the payment is not authorised or the data provided are incomplete or inaccurate; in that case any amount already paid is refunded. Each order confirmation and these Terms are stored by the Seller and can be requested by writing to [email protected].
Payment can be made with the methods shown at checkout, which currently include the main credit and debit cards and PayPal. Payments are processed by certified third-party providers on secure, encrypted pages: the Seller never receives or stores your full card details. The amount is charged when the order is confirmed.
Products are shipped by express courier to the address indicated in the order, within the countries listed at checkout. Orders are normally prepared within 1-2 working days of the order confirmation; delivery times are indicative and depend on the destination and on the courier. Shipping costs and any free-shipping threshold are shown at checkout. You will receive a tracking link by email as soon as the parcel leaves our warehouse. Please check the parcel on delivery: if the packaging is visibly damaged, accept it with reservation or refuse the delivery, and contact us within 48 hours with photographs so that we can replace or refund the damaged items.
As a consumer you have the right to withdraw from the contract, without giving any reason, within 14 days from the day on which you (or a person indicated by you) receive the products. To exercise this right, send a clear statement (for example an email to [email protected], stating the order number) before the 14-day period expires. You must then return the products, at your own expense, within 14 days of your withdrawal statement to: Aziende Agricole Scyavuru S.r.l., Contrada Castellana SNC, 92016 Ribera (AG), Italy.
In accordance with art. 59 of the Consumer Code, the right of withdrawal does not apply to sealed food products that have been unsealed after delivery, for hygiene and food safety reasons, nor to products that deteriorate or expire rapidly. Products must therefore be returned intact, unopened, with the original seal and packaging. The Seller will refund the price paid, including standard delivery costs, within 14 days of receiving the returned products (or proof of their dispatch), using the same payment method used for the purchase. The refund may be reduced if the products show a diminished value caused by handling beyond what is necessary to establish their nature and characteristics.
All products are covered by the legal guarantee of conformity provided for by articles 128-135 of the Consumer Code. Given the nature of food products, any lack of conformity (for example damaged, spoiled or wrong products) must be reported as soon as possible and in any case within the best-before date shown on the label, by writing to [email protected], with the order number and photographs. The Seller will replace the product or refund the price, at your choice, at no cost to you.
The Seller is not liable for delays or failures in delivery caused by force majeure or by events beyond its reasonable control, nor for damage caused by improper storage or use of the products after delivery. Nothing in these Terms limits the rights granted to consumers by mandatory law.
Personal data are processed in accordance with the Privacy Policy and the Cookie Policy, which form an integral part of these Terms.
For any complaint or request you can write to [email protected]; we will answer as quickly as possible. Any dispute concerning these Terms is subject to Italian law and, where the customer is a consumer, to the mandatory jurisdiction of the court of the place where the consumer resides or is domiciled. Consumers residing in the European Union may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
The Seller may update these Terms at any time. The version applicable to each order is the one published on the Shop and accepted at the moment the order is placed.
